These Terms of Service ("Terms") govern your use of our web application platform and related services (collectively, the "Service") operated by DIGISCALE TECHNOLOGIES (OPC) PRIVATE LIMITED, a company incorporated under the laws of India with CIN: U62011GJ2025OPC165513.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

3. Service Description
Digiscale provides a subscription-based freemium web application platform that offers various digital services and solutions. Our Service operates on a freemium model with both free and paid subscription tiers.
3.1 Freemium Model
- Free Tier: Limited access to basic features and functionality
- Paid Subscriptions: Enhanced features, increased usage limits, and premium support
- Trial Periods: May be offered for premium features on a time-limited basis
4. User Accounts and Registration
4.1 Account Creation
To access certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration, including:
- Full name
- Email address
- Phone number
- Company name (if applicable)
- GST number (for business billing in India)
4.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.
4.3 Account Termination
You may terminate your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.
5. Subscription and Billing Terms
5.1 Subscription Plans
We offer various subscription plans with different features and usage limits. Plan details, pricing, and features are available on our website and may be updated from time to time.
5.2 Billing and Payment
- Subscription fees are billed in advance on a recurring basis (monthly or annually)
- All fees are in Indian Rupees (INR) unless otherwise specified
- GST and other applicable taxes will be added to your bill as required by law
- Payment is due immediately upon invoicing
- Failed payments may result in service suspension or termination
5.3 Refunds and Cancellations
5.3.1 Cancellation Process
- You may cancel your subscription at any time from your account settings or by emailing our support team
- Cancellations take effect at the end of the current billing period
- You will receive email confirmation of your cancellation request
- Account data remains accessible until the end of your billing period
5.3.2 Refund Policy
- 14-Day Money-Back Guarantee: New subscribers and existing users upgrading to a higher-tier plan may request a full refund within 14 days of their payment
- Annual Subscriptions: Pro-rata refunds available if cancelled within 30 days of initial payment. Refund calculated as: (Unused days ÷ 365) × Annual fee paid
- Service Failure Refunds: Service credits available upon request for documented outages exceeding 4 hours:
- 4-8 hours: 10% monthly credit
- 8-12 hours: 25% monthly credit
- 12-24 hours: 50% monthly credit
- 24+ hours: 100% monthly credit
- Billing Errors: Full refunds for incorrect charges upon verification
- Processing Time: Approved refunds processed within 5-10 business days to original payment method
5.3.3 Refund Exceptions
Partial month refunds are not available for voluntary cancellations after the 14-day money-back guarantee period. This limitation does not apply to refunds for billing errors, documented service failures, or where required by applicable consumer protection laws.
No refunds will be provided for:
- Account termination due to Terms of Service violations
- Fraudulent or abusive usage patterns
- Violation of Acceptable Use Policy
Custom refund terms may apply to Enterprise customers as specified in individual Service Agreements, which shall supersede these standard terms.
5.3.4 Billing Dispute Resolution Process
For billing disputes, refund requests, or payment-related concerns:

Resolution Timelines:
- Simple Disputes (billing errors, duplicate charges): 24-48 hours
- Complex Disputes (service level disagreements): 5-7 business days
- Escalated Disputes: 10-14 business days
Process Steps:
- Acknowledgment within 2 hours during business hours
- Investigation updates provided every 24 hours
- Written confirmation of all resolutions
- Escalation to management for unresolved disputes
Appeals Process:
- Submit appeal within 14 days of resolution notification
- Manager review within 5 business days
- Final company decision within 10 business days
- External arbitration option per Section 12.3 for disputes above INR 25,000
5.4 Price Changes
We reserve the right to modify subscription pricing with 30 days' advance notice. Price changes will not affect your current billing period.
6. Service Availability and Support
6.1 Service Level
While we strive to maintain high availability, we do not guarantee uninterrupted service. We may perform scheduled maintenance that temporarily affects service availability.
6.2 Support
- Free tier users: Community support and documentation
- Paid subscribers: Email support with reasonable response times
- Enterprise customers: Dedicated support as per agreement
6.3 Digital Service Provisioning
- Account Activation: Immediate upon successful registration and email verification
- Paid Subscription Access: Instant upon payment confirmation
- Service Availability Target: 99.5% uptime (excluding scheduled maintenance)
- Account Setup: Complete within 5 minutes of successful payment processing
6.4 Digital Onboarding Process
- Welcome Email: Delivered within 15 minutes of account creation
- Account Verification: Email confirmation required within 24 hours of registration
- Setup Guidance: Available immediately upon first login via user dashboard
- Support Documentation: Accessible through help center and in-app tutorials
- Initial Configuration: Basic setup wizard available upon account activation
7. Acceptable Use Policy
You agree not to use our Service to:
- Violate any applicable laws, regulations, or third-party rights
- Transmit malicious code, viruses, or harmful software
- Engage in unauthorized access or security breaches
- Spam, harass, or send unsolicited communications
- Infringe intellectual property rights
- Use the Service for illegal or fraudulent activities
- Attempt to reverse engineer or copy our software
8. Intellectual Property Rights

10. Disclaimers and Limitation of Liability
10.1 Service Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGISCALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF THE SERVICE.
10.3 Liability Cap
Our total liability to you for all claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or INR 10,000, whichever is lower.
11. Indemnification
You agree to indemnify and hold harmless Digiscale, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
12.2 Jurisdiction
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Navsari, Gujarat, India.
12.3 Dispute Resolution
We encourage resolving disputes through direct communication. For formal disputes, we prefer arbitration under the Arbitration and Conciliation Act, 2015 before pursuing court proceedings.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or service notification. Continued use after changes constitutes acceptance of the modified Terms.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement
These Terms constitute the entire agreement between you and Digiscale regarding the use of our Service and supersede all prior agreements and understandings.
